Welcome to Mimontee. These Terms of Service (“Terms”) govern your use of our website and your purchase of our solid wood furniture products. The website is operated by Mimontee (“we”, “us”, “our”).
By visiting our site and/or purchasing something from us, you agree to be bound by these Terms, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
Service Area: Our store currently serves customers exclusively in the Contiguous United States (Lower 48 States). We do not ship internationally or to Alaska, Hawaii, or P.O. Boxes.
2. General Conditions

Age Requirement: You must be at least 18 years old to place an order.

Accuracy: You agree to provide current, complete, and accurate purchase and account information (including email, shipping address, and phone number) for all purchases.

Right to Refuse: We reserve the right to refuse service to anyone for any reason at any time, including the right to limit quantities or cancel orders that appear to be fraudulent.
3. Product Specifics: The Nature of Solid Wood
We sell products made from 100% Solid Wood. By purchasing from Mimontee, you acknowledge and agree to the unique characteristics of natural materials:

Natural Variations: Wood is a living material. Variations in grain pattern, color tones, knots, and texture are inherent features of nature and are not considered defects. No two tables are exactly alike.

Wood Movement: Solid wood responds to its environment. Slight expansion and contraction may occur due to changes in temperature and humidity. This is normal behavior for wood.

Screen Representation: We try to display colors as accurately as possible. However, your monitor’s display may differ slightly from the actual wood finish.

Props: Product photos may show accessories (chairs, laptops, lamps) for styling purposes. Your purchase includes only the table/desk as described in the product title.
4. Care & Usage (Disclaimer)
To ensure the longevity of your table, you must follow standard wood care practices. Mimontee is not responsible for damage caused by:

Placing the furniture outdoors (our products are for indoor use only).

Exposure to extreme temperatures (e.g., placing the table directly next to a radiator, fireplace, or AC vent).

Exposure to direct sunlight for prolonged periods (which may cause fading).

Improper assembly or exceeding reasonable weight limits.

Use of harsh chemicals or abrasives for cleaning.
5. Pricing and Payment

Currency: All prices are listed in U.S. Dollars (USD).

Sales Tax: We are required by law to collect sales tax on orders shipped to certain states. This is calculated automatically at checkout.

Price Changes: Prices for our products are subject to change without notice. We guarantee the price only once an order is placed and confirmed.
6. Shipping & Freight Delivery
Because our products are heavy, they are often shipped via LTL Freight Carriers. By placing an order, you agree to the following delivery terms:

Curbside Delivery: The driver will lower the pallet to the curb at the end of your driveway. They will not bring the item inside your home, up stairs, or assemble it.

Appointments: For freight shipments, the carrier will contact you to schedule a delivery window. You must be present to sign for the delivery.

Redelivery Fees: If you miss your scheduled delivery appointment, the carrier will charge a Redelivery Fee (often $50–$100). You agree that Mimontee may pass this cost on to you or deduct it from any refund.

Address Changes: Changing the shipping address after the order has shipped will incur a Re-consignment Fee charged by the carrier.
7. Inspection & Damage Reporting
Your signature on the delivery receipt is a legal document.

Inspect Upon Arrival: You must inspect the outer packaging before the driver leaves.

Damage: If the packaging is damaged, you must write “DAMAGED” on the delivery receipt or Refuse the shipment.

Reporting: If you discover concealed damage after unpacking, you must notify us within 48 hours of delivery with photos. Failure to report within this window may result in the denial of your claim.
8. Return and Refund
Our Return & Refund Policy is strictly enforced due to the logistics of heavy furniture.

30-Day Window: Returns are accepted within 30 days of delivery.

Condition: Items must be Unassembled and in Original Packaging.

Return Shipping: For personal preference returns (“Change of Mind”), the customer is responsible for return freight costs, which can be substantial.

Restocking Fee: We reserve the right to charge a restocking fee (up to 30%) if the item is returned damaged due to poor packing by the customer.
9. Limitation of Liability
To the fullest extent permitted by law, Mimontee shall not be liable for any special, incidental, or consequential damages (including lost profits or loss of use) arising out of the use or inability to use our products. Our maximum liability to you for any claim shall not exceed the amount you paid for the product.
10. Governing Law
These Terms and any separate agreements shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
11. Changes to These Terms
We reserve the right to update or change these Terms at any time. The most current version will always be posted on this page. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
